Basic Guide to Maryland Unemployment Insurance Appeals

If you have lost your job through no fault of your own, especially in the current difficult economy, unemployment benefits can be the difference between eviction or foreclosure and keeping your owned or rented home. In the U.S., unemployment benefits are significantly less generous than in most of our industrialized allied countries and trading partners; we Americans generally receive lower benefits and for a shorter period than do most Europeans, for example. Yet our modest, limited benefits can be crucial to surviving in a terrible economy.

Unemployment hearings in Maryland occur in three stages -

- The telephone or "claims specialist" stage
- The Lower Appeals or "Hearing Examiner" stage, and
- The Board of Appeals in some cases.

Generally, the claims specialist conducts a mere telephone interview with the worker or "claimant" and with the employer, and renders a preliminary decision as to eligibility. If either party disagrees with the decision, either may file for an appeal of the decision to a hearing examiner for a "de novo" (all new, "do-over") hearing before the hearing examiner in an unemployment office location or other State office complex. That Lower Appeals hearing is recorded live, usually conducted in a small room and is generally limited to 45 minutes in length.

If the Lower Appeals decision reverses the telephone hearing, a dissatisfied party may appeal to the UI Board of Appeals; in most other cases, the appeals go to the Circuit Court for a judicial appeal that is based on the Lower Appeals record, i.e. NOT a "do-over from the top" but a review to determine legal errors and very gross factual errors only. Accordingly, it's important to take the Lower Appeals hearing seriously; it's worth it in most cases to hire an attorney or at least to consult with one.

The two main issues in unemployment cases are misconduct (of varying degrees) and voluntary quit for cause.
In a misconduct case, the employer has the burden of proof of showing conduct by the worker that either violates a fairly communicated workplace rule or otherwise manifested gross disregard for the interests of the employer. Misconduct grades run from (simple/petty) misconduct which involves a penalty of benefit "weeks", to gross misconduct and aggravated misconduct which bar all access to UI benefits until the worker is rehired and earns through wages/salary an amount of compensation equal to a large factor of the weekly benefit pay-out.

Voluntary quit for a serious justified cause related to the job itself allows the worker to keep unemployment benefits, whereas voluntary quit for the lesser "valid circumstances" related to the job or to the worker's personal circumstances may result in a penalty of benefit weeks. Voluntary quit for insufficient cause bars benefits entirely until a worker is rehired and earns back into the system. Sometimes, it's a close call whether a worker quit or was terminated.

Maryland has just increased the penalties for workers who get fired for misconduct; effective March 1, 2011 the penalty will be the loss of 10-15 weeks (up from 5-10 weeks) of benefits for a misconduct firing, and a requirement to earn 25 benefit weeks (up from 20 weeks) worth of wages for a gross misconduct firing before being re-admitted to eligibility. It's more important now than ever to consider hiring legal counsel in Maryland in a misconduct claim due to the even higher stakes for a loss.

Most Maryland attorneys do not do unemployment hearings; there's a reason why you see advertisements for car accident lawyers and medical malpractice lawyers and DWI/DUI lawyers, but almost none for unemployment insurance lawyers. One might think that in this economy, the demand for unemployment attorneys would be very high - and demand is so high that at least one Bar Association Lawyer Referral Service in Maryland has been soliciting lawyers to take more of these cases. Legal fees in unemployment cases are capped by state regulation and a somewhat burdensome review of the bills by the Unemployment Insurance office. Accordingly, most attorneys shy away from these cases for those reasons. Fortunately, some lawyers do practice in this area in Maryland.

Of the public records that are most widely searched, Marriage Records must rank tops. What do people look for and what are their reasons for it?

Marriage records are generally maintained at the county offices where the marriage license was issued. With computerization, the majority of states will have uploaded all public records onto a state repository. Since Texas marriage records are under state jurisdiction, they will be no exception. At a basic level, they include name, age, residence, occupation, birth place, time and place of marriage, some particulars of parents, witnesses and the conducting official of the ceremony. A key point fundamental to the purpose of many a marriage record search is previous marriages, if any, will show up.

When applying for a license to be married, marriage records of both the prospective husband and wife must be produced as proof of their eligibility. When the new wife is seeking a name change, they are required for substantiation. This is important as the name change itself is often a prerequisite to a further purpose such as immigration, adoption, joint tax returns, social security matters, insurance, medical and many other benefits.

Certified copies can also be used as proof of identification or status when making claims to inheritance, marital assets, rights, privileges or even royalty. Locating biological parents or parents, especially mothers, identifying themselves to their natural children after a name change are also situations where they will come in handy.

Genealogy and family tree researchers will also find them to be an invaluable resource. Start with a small branch and you'd be surprised at how the various connecting marriage records can quickly help to complete the entire tree. Inevitably, there are downsides to their significance too. Lawyers are known to make wry use of them to establish targeted character perception of people involved in legal proceedings upon the jury or judges. Journalists and reporters also commonly employ its juicy appeal to enhance their viewer ratings.

Most of all, the mother of all marriage records search purposes is to look for what we hope not to find when checking on a future spouse. Love is blind but statistics and records don't lie. It's just a little due diligence compared to the enormity of taking the big plunge. Besides, it is relatively hassle-free these days to conduct a state marriage records search on virtually anyone. With as little as a name and speculative state of residence (Texas, California, Alaska....), we could be scrutinizing someone's marital past within minutes.

Killenbeck recounts how the cashier of the Baltimore branch of the Second Bank of the United States refused to pay Maryland's tax on the bank and how that act precipitated a showdown in the Supreme Court, which addressed two questions: whether the U.S. Congress had the authority to establish a national bank and whether Maryland's tax on the bank was barred by the Constitution. In one of Chief Justice John Marshall's most famous opinions, the Court unanimously answered yes to both, authorizing the federal government to exercise powers not expressly articulated in the Constitution-and setting an alarming precedent for states' rights advocates.

The issues at the heart of M'Culloch are as important today as they were then: the nature and scope of federal constitutional authority, the division of authority between federal and state governments, and the role of the Supreme Court in interpreting and applying the Constitution. Situating the case within the protracted debate about the bank and about federal-state relations, the Panic of 1819, the fate of the Second Bank following the Court's momentous decision, and the ever-expanding and increasingly contentious debate over slavery, Killenbeck's book provides a virtual constitutional history of the first fifty years of the nation. As such, it shows that the development of the Constitution as a viable governing document took place over time and that M'Culloch, with its very broad reading of federal power, marked a turning point for the Constitution, the Court, and the nation.

Marylander Edward Erbery called members of the colony's proprietary assembly "rogues and puppies"; he was tied to an apple tree and received thirty-nine lashes. Jacob Lumbrozo, a Maryland Jew who suggested Christ's miracles were done by "magic," was imprisoned indefinitely, escaping execution only by the governor's pardon. Rebecca Fowler was accused of using witchcraft to cause her Calvert County neighbors to feel "very much the worse;" she was hanged on October 9, 1685. Mrs. Thomas Ward whipped a runaway maidservant with a peachtree rod, then rubbed salt into the girl's wounds; the girl died, and Mrs. Ward was fined three hundred pounds of tobacco.

Now available in a new paperback edition, Raphael Semmes's classic Crime and Punishment in Colonial Maryland contains a wealth of colorful -- though often disturbing -- details about the law and lawbreakers in 17th-century Maryland. Semmes explains, for instance, that theft was rare among early Marylanders -- if only because the colonists had little worth stealing. But what the colonists valued, they endeavored to protect: A 1662 law punished a person twice-convicted of hog-stealing by branding an "H" on his shoulder. (Widely perceived as being too lenient, the law was amended four years later: first offense, "H" on the forehead.) Men caught in adultery were often fined; women were often whipped. And knowing how to swim was so rare among 17th-century women that suggesting one could do so was tantamount to accusing her of witchcraft: a minister's son who claimed as much was sued by the woman for defamation of character.

Crime and Punishment in Colonial Maryland offers fascinating and detailed case histories on such crimes as theft, libel, assault and homicide, as well as on adultery, profanity, drunkenness, and witchcraft. It also explores long-forgotten aspects of old English law, such as theftbote (an early form of "victim compensation"), deodand (an animal or article which, having caused the death of a human being, was forfeited to the Crown for "pious uses"), and the blood test for murderers.

MARYLAND CAMPAIGN OF SEPTEMBER 1862: Volume 1, South Mountain Overview

When Robert E. Lee marched his Army of Northern Virginia into Maryland in early September 1862, Maj. Gen. George B. McClellan moved his reorganized and revitalized Army of the Potomac to meet him. The campaign included some of the bloodiest, most dramatic, and influential combat of the entire Civil War. Combined with Southern failures in the Western Theater, the fighting dashed the Confederacy's best hope for independence, convinced President Abraham Lincoln to announce the Emancipation Proclamation, and left America with what is still its bloodiest day in history.

One of the campaign's participants was Ezra A. Carman, the colonel of the 13th New Jersey Infantry. Wounded earlier in the war, Carman would achieve brigade command and fight in more than twenty battles before being mustered out as a brevet brigadier general. After the horrific fighting of September 17, 1862, he recorded in his diary that he was preparing "a good map of the Antietam battle and a full account of the action." Unbeknownst to the young officer, the project would become the most significant work of his life.

Appointed as the "Historical Expert" to the Antietam Battlefield Board in 1894, Carman and the other members solicited accounts from hundreds of veterans, scoured through thousands of letters and maps, and assimilated the material into the hundreds of cast iron tablets that still mark the field today. Carman also wrote an 1,800-page manuscript on the campaign, from its start in northern Virginia through McClellan's removal from command in November 1862. Although it remained unpublished for more than a century, many historians and students of the war consider it to be the best overall treatment of the campaign ever written.

Dr. Thomas G. Clemens (editor), recognized internationally as one of the foremost historians of the Maryland Campaign, has spent more than two decades studying Antietam and editing and richly annotating Carman's exhaustively written manuscript. The result is 'The Maryland Campaign of September 1862', Carman's magisterial account published for the first time in two volumes. Jammed with firsthand accounts, personal anecdotes, maps, photos, a biographical dictionary, and a database of veterans' accounts of the fighting, this long-awaited study will be read and appreciated as battle history at its finest.

About the Authors: Ezra Ayres Carman was born in Oak Tree, New Jersey, on February 27, 1834, and educated at Western Military Academy in Kentucky. He fought with New Jersey organizations throughout the Civil War, mustering out as a brevet brigadier general. He was appointed to the Antietam National Cemetery Board of Trustees and later to the Antietam Battlefield Board in 1894. Carman also served on the Chattanooga-Chickamauga Battlefield Commission. He died in 1909 on Christmas day and was buried just below the Custis-Lee mansion in Arlington Cemetery.

Thomas G. Clemens earned his doctoral degree at George Mason University, where he studied under Maryland Campaign historian Dr. Joseph L. Harsh. Tom has published a wide variety of magazine articles and book reviews, has appeared in several documentary programs, and is a licensed tour guide at Antietam National Battlefield. An instructor at Hagerstown Community College, he also helped found and is the current president of Save Historic Antietam Foundation, Inc., a preservation group dedicated to saving historic properties.

These four essays explore famous battles on Maryland soil such as Antietam, and little known episodes such as Maryland’s invasion of the Eastern Shore counties of Virginia, followed by the military occupation of Delaware!

The first essay, “The Setting, 1859-1860,” explores the Southern sympathies of the Eastern Shore, and slavery as an institution here. We trace the contributions and legacy of Eastern Shore natives Harriet Tubman and Frederick Douglass.

The second essay, “The Crisis, 1861,” concentrates on the efforts of Governor Hicks to keep Maryland in the Union. It is a thrilling story and a surprising one, for Hicks, a Dorchester County farmer who had been elected thanks to the Know-Nothing (American) Party nomination in 1857, soon found himself fighting the grand issues of the day with a General Assembly that was controlled by Southern Democrats. The pressures to at least convene a legislative convention to consider the secession issue – as Virginia was doing at the same time – caused enormous pressure. And the Pratt Street Riots of April 19, 1861, when federal troops passing through Baltimore ran into a rioting gang of outraged civilians, caused emotions to run at fever pitch.

Hicks’s nightmare came about, as Maryland became a “Battlefield, 1861-1863,” the third essay. Here, I hope that readers will take their Kindles with them to the battlefields of Antietam, South Mountain, and Monocacy, follow the narrative, and ponder over the sacrifices made on those battlefields. Antietam still holds the doleful record of the greatest American casualties ever sustained in one day.

In the fourth essay, “Last Rolls of the Dice, 1864-1865,” we follow the desperate gamble of General Jubal Early, CSA, to capture Washington. And of course, the path of deluded actor John Wilkes Booth is treated here, both the assassination of Lincoln, and the strange episode of Dr. Samuel Mudd, of Bryantown in Southern Maryland, who treated the injured Booth and just missed the death penalty at his ensuing trial.

Since Marylanders fought on both sides, neither should be forgotten. The Maryland Memorial at Gettysburg, seen on the cover of this e-book, portrays the scene, two wounded soldiers, USA and CSA, helping each other as they limp along. For a conflict that pitted brothers against each other, sometimes literally, that symbol of coming together is a worthy one, as Americans still ponder the past, and its lessons for the present.
